Residential Service Terms & Conditions

1. Payment Terms

\nPayment Due Date: Payment is due in full immediately upon completion of the service.
\nProper Invoice: All bills issued will be \"Proper Invoices\" as defined by the Prompt Payment and Construction Lien Act. This means you must pay within 28 days of receiving the invoice unless you provide a formal \"Notice of Dispute\" within 14 days.

2. Late Payments and Interest

To be legally enforceable under the federal Interest Act and Alberta law, interest must be disclosed as a yearly rate.

\nLate Interest: Unpaid balances will accrue interest at a rate of 2% per month (24% per annum).
\nAdministration Fee: A one-time late payment administration fee of $50.00 (representing the reasonable cost of manual follow-up and reconciliation) will be applied to any account that remains unpaid 30 days after the service date.

3. Non-Payment and Liens

\nConstruction Liens: Under the PPCLA, the Company has the legal right to register a lien against your property if payment is not received. For work in Alberta, the deadline to register a lien is 60 days from the last day services were provided.
\nCollection Costs: The Client agrees to pay all costs incurred by the Company to collect unpaid balances, including legal fees and third-party collection agency commissions.

4. Cancellation and Access

\nCancellation: Please provide at least 24 hours' notice for cancellations. Cancellations with less than 24 hours' notice may be subject to a $50.00 service fee.
\nAccess: The Client must ensure clear access to the furnace and all vents. The Company is not responsible for moving heavy furniture or valuables.

5. Consumer Rights (Alberta Consumer Protection Act)

\nCancellation Rights: If this contract was signed in your home, you have a 10-day \"cooling off\" period during which you may cancel the contract without penalty.
\nPrepaid Contracts: If the Company requires a deposit of $200 or more before work is complete, we must maintain a Prepaid Contracting License with Service Alberta.

6. Onsite Cancellation & Rescheduling Fee

\nService Call Fee: If a technician arrives at the scheduled time and the Client cancels the service, requests to reschedule, or is not present to provide access, a flat Service Call Fee of $[100.00–150.00] plus GST will be charged immediately.
\nPurpose of Fee: This fee is non-refundable and represents a reasonable estimate of the Company’s costs for travel, fuel, and the technician’s dispatched time.
\nRescheduling Credit: At the Company’s sole discretion, if the service is successfully rescheduled and completed within 30 days, 50% of this Service Call Fee may be applied as a credit toward the final invoice.
\nNotice Period: To avoid this fee, the Client must provide at least 24 hours' notice for any changes to the appointment time.

Commercial Service Terms & Conditions

1. Payment Terms (Commercial)

\nStandard Terms: Our standard payment term for commercial accounts is Net 30.
\nExtended Terms (Net 45): By prior written agreement only, the Company may accept Net 45 terms. Accounts granted Net 45 terms may be subject to a adjusted \"Extended Term Service Rate\" to account for the cost of carrying the account, as disclosed in the initial service quote.

2. Proper Invoicing (Alberta Prompt Payment Compliance)

To ensure timely processing, all invoices will be issued as \"Proper Invoices\" under the Alberta Prompt Payment and Construction Lien Act (PPCLA).
Invoices will include: Contractor name/address, date, period of service, description of work, amount requested, and a statement that the document is intended to be a Proper Invoice.
\nNote: Under the PPCLA, once a proper invoice is received, undisputed amounts must generally be paid within 28 calendar days unless a formal \"Notice of Dispute\" is provided within 14 days.

3. Late Fees and Interest Disclosure

\nOverdue Accounts: Any balance remaining unpaid after the agreed Net term (30 or 45 days) is considered overdue.
\nInterest Rate: Overdue commercial accounts will be charged interest at a rate of 2% per month (24% per annum).
\nAdministrative Late Fee: In addition to interest, a one-time administrative fee of $50.00 (or the maximum reasonable cost allowed under Alberta law to cover processing and collection overhead) will be applied to each invoice that remains unpaid beyond the agreed Net 30 or Net 45 term.
\nLegal Compliance: Per the federal Interest Act, this rate is expressed annually to remain enforceable. If a rate is stipulated but not explicitly stated as an annual percentage, a default rate of 5% per annum applies by law.

4. Administrative Fees for Manual Payments

\nCheque Processing: Clients paying via physical cheque will be subject to a $15.00 administrative fee per transaction to cover manual reconciliation and bank processing costs.
\nElectronic Payment: This fee is waived for payments made via Electronic Funds Transfer (EFT) or Interac e-Transfer.

5. Right to Suspend Service

The Company reserves the right to suspend or terminate ongoing maintenance or scheduled services if any invoice remains unpaid for more than 15 days beyond the agreed Net term.

6. Collection and Legal Costs

In the event of non-payment requiring legal action, the Client agrees to pay all reasonable collection costs, including legal fees on a solicitor-client basis
